“Stu Flashman has been an excellent adviser and staunch ally in our efforts to help protect open space and parks in Martinez. He has given unstintingly of his time and expertise over the last five years. His extensive knowledge and decades of experience have been critical to the success of our referendum, our initiative and the several complex legal issues in which he has represented us. He has been tireless in his support, giving us sage counsel and representing us before our City Council and in court on numerous occasions. In the face of our status as novices, he has been endlessly patient in helping us craft the best possible strategies and responses, resulting in our being able to stand up to strong opposition, and achieve positive results for our community. We could not have succeeded without his help, and we are very grateful for his working with us. Our group’s goals were to oppose our City Council’s conversion of a major parcel from open space to housing, and to put into law protections for all open space in Martinez in the future. Our efforts included: (1) a referendum to force a public vote on the City Council’s conversion of open space to market-rate housing, (2) an initiative to require that future such conversions get voter approval, and, (3) numerous legal actions including a SLAPP suit and appeal, a lawsuit to keep the City Council from rewriting 43 years of history, and a City legal challenge to the initiative. Stu was in the middle of every one of these efforts. He, along with his co-counsel, defended us in the SLAPP suit brought by the developer and owner to try to stop us, and won both the case and the appeal (also getting the decision on appeal published as legal precedent). He guided us in preparing our referendum petition, and helped us through every step of the referendum process. He helped us write a much more complicated initiative measure, and not only led us through that labyrinthine process, but defended us in court when the City Council sued us trying to invalidate the initiative. He, along with his co-counsel, was instrumental in our lawsuit against the City Council’s rewriting the history of the parcel they were trying to convert to market-rate housing. He was also central to the mediation that came about to address all these actions. The mediation has resulted in a master agreement between the City, the developer/owner and us which includes, among other things, a new City park. Stu is now actively advising us on implementing the agreement. Stu has played many roles for us, and been excellent in all of them. We are lucky to have had him working with us. We could not have gotten this far without him, and are sincerely grateful for his help.”
